Commissioners Not Expected to Consider Public Input Thoroughly


During public comments and other input related to the Martin Marietta Materials application for a Use by Special Review to operate an aggregate processing facility, the surrounding communities and neighbors offered hundreds of pages of documentation providing evidence of flaws in the claims by Martin Marietta Materials and Tetra Tech in their application. Yet, the Commissioners apparently did not consider any of it. Not only did they ignore the input of the public and the surrounding communities of Windsor, Greeley, and Johnstown, they also ignored the recommendations of the Planning Department staff and the Planning Commission.

In other hearings since then, the Commissioners sometimes seemed to consider public input, but it is not predictable or consistent. The inconsistency and lack of predictability makes it easier for the Commissioners to abuse their considerable discretion in land use cases.
