[CLICK ON THE POST IF NEEDED TO SEE THE ENTIRE POST] Once Martin Marietta Materials transferred operating control of the Highway 34 facility to Rock and Rail, Rock and Rail sued the CLR-34 plaintiffs from the earlier case, claiming we had no right to take legal action against them. The plaintiffs filed a countersuit responding to all their claims. After subpoenas and depositions, the CLR-34 plaintiffs filed a motion for summary judgment for part of the case: that the concrete operations are NOT eligible for STB exemption.
